An arrest in 2011 in another case led a Delhi court to dismiss the claim of juvenility by one of the six accused in the rape of 51-year-old Danish tourist here.The court was presented with the age-determination test report of Arjun alias Ajay from 2011 attested by the Superintendent of Children Home for Boys along with the present age test report.“In terms of the said report, it has been stated that on previous occasion on September 30, 2011, after the arrest of this accused in some other case, his age determination test was carried out wherein the Board of Doctors opined his age to be between 17 and 18 years,” Additional Chief Metropolitan Magistrate Sudhanshu Kaushik said.“The accused has never gone to school and no other document pertaining to his age is traceable. The offence (Danish woman rape) in respect of which the present FIR has been registered was committed on January 14.Thus, even if, margin of one year on the lower side is granted to the accused, still, it cannot be concluded that he is a juvenile in need of care and protection. The application wherein this accused has taken plea of juvenility is dismissed,” said Mr. Kaushik.Arjun, who the police claim to be 21 years old, had on February 21, claimed that he was a juvenile after which the court had asked the police to ascertain his claim.Besides Arjun, the other five adult accused are Mahendra alias Ganja (24), Mohd. Raja (22), Raju (23), Raju Chakka (22) and Shyam Lal alias Bhajni (55). Two other accused are juveniles and aged 17 years.Shyam Lal had claimed impotency. A verification report of the same is awaited.They are all accused of raping the Danish woman at knife point on the night of January 14.
